Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, portals, services, and tools (collectively, the “Services”) provided by Cultural Nexus Indigenous Corporation (Australian Business Number: 14 905 985 838 | Indigenous Corporation Number: 10462), including its subsidiaries, affiliates, and brands such as Indigenous Job Match (IJM) and PNG Careers (“CNIC”, “we”, “us”, or “our”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Services.
1. Definitions
“User” means any individual or entity accessing or using the Services.
“Content” refers to all material published, shared, uploaded, or displayed on the Services.
“Affiliate” means any entity under the CNIC umbrella, including subsidiaries, partners, and associated initiatives.
“Confidential Information” includes sensitive, cultural, commercial, or personal data, particularly relating to Aboriginal and Torres Strait Islander peoples or Papua New Guinean citizens.
2. Eligibility
You must be at least 18 years old to access or use our Services. If you are entering into this agreement on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation.
3. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
Violate any applicable local, state, national, or international law or regulation;
Infringe upon the rights of others, including intellectual property or cultural rights;
Upload or distribute malicious software, spam, or harmful content;
Use the Services in any way that could damage, disable, or impair the proper functioning of our platforms.
4. Cultural Respect and Protocols
As a First Nations–led organisation, CNIC embeds cultural protocols into all programs and platforms. Users agree to:
Engage respectfully with Aboriginal and Torres Strait Islander content, people, and processes;
Refrain from unauthorised use of culturally sensitive imagery, stories, or data;
Seek appropriate cultural permissions where relevant.
Violation of these protocols may result in termination of access and potential legal action under relevant Indigenous cultural rights frameworks.
5. Intellectual Property
All materials, including text, graphics, logos, documents, and proprietary tools, are the property of CNIC or its licensors. You may not reproduce, distribute, or adapt any content without prior written consent, unless otherwise permitted under Australian Copyright Law.
6. Privacy
Your use of our Services is also governed by our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and Australian Privacy Principles. By using our Services, you consent to the collection, use, and disclosure of personal information as outlined in that policy.
7. Third-Party Services
We may link to or integrate third-party platforms, including Squarespace, Zoho, Gmail (Google Workspace), and payment gateways. We do not control or accept responsibility for their actions, terms, or policies. Your interaction with third-party services is at your own risk.
8. Payment and Subscription Terms
If you purchase paid services (e.g., job ad credits, mentoring packages, recruitment tools), you agree to:
Pay all fees as outlined at the time of purchase;
Provide accurate billing and contact information;
Acknowledge that failure to pay may result in suspension or termination of services.
Refunds are subject to our Refund Policy and Australian Consumer Law.
9. Limitation of Liability
To the fullest extent permitted by law, CNIC and its affiliates are not liable for:
Any indirect, incidental, special, or consequential damages;
Any loss of data, revenue, profits, or goodwill;
Any unauthorised access or use of our systems, even if we have been advised of the possibility.
Our total liability arising from or related to the Services shall not exceed AUD $100 or the amount paid by you in the past 12 months, whichever is greater.
10. Termination
We may suspend or terminate your access to the Services at our discretion, with or without notice, if:
You breach these Terms;
We are required by law or regulatory authority;
Your behaviour presents a risk to cultural, community, or data safety.
Upon termination, your right to access or use the Services immediately ceases. Relevant data may be archived, anonymised, or deleted per our Data Retention Policy.
11. Indemnity
You agree to indemnify, defend, and hold harmless CNIC and its directors, officers, staff, and affiliates from any claims, liabilities, damages, losses, or expenses arising from:
Your breach of these Terms;
Your misuse of the Services;
Your infringement of cultural, legal, or intellectual property rights.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland. We operate in accordance with applicable Commonwealth, State, and Indigenous legal frameworks.
13. Updates to These Terms
We reserve the right to update these Terms at any time. Continued use of our Services following changes constitutes acceptance. The current version will always be available on our official website(s).
